Criminal Protection of Children and Its Challenges in Iranian Criminal Law in the Light of Humanitarian Law

Abstract
In terms of humanitarian law, the principle of distinguishing civilians from civilians and prohibiting inhumane
targets and methods during armed conflict are among the fundamental principles that are important. It is one of
the most vulnerable groups during the war, children and children, and criminal protection of them in the realm
of each country's legislative policy seems necessary. The purpose of writing this article is to study the criminal
protection of children in a comparative and critical way with a comparative view in international documents,
especially the Convention on the Rights of the Child and the four Geneva Conventions on Iranian Criminal Law,
and the challenges of Iranian criminal law. Identify.
The findings of the study indicate that, firstly, criminal protection of children is mentioned in numerous and
scattered legal materials, and Iran's criminal policy lacks the necessary coherence. Second, Iran's criminal law
and regulations are set only for the time of peace and do not regulate specific rules of war. Third, the most
important challenges to Iran's accession to the Convention on Human Rights are the fundamental and
ideological differences between Iranian and Western law, the legitimacy of the right to bet, and the religious
nature of human rights in Iran. Fourth, it is necessary to pay attention to the capacity of the Islamic Republic of
Iran and to highlight Iran's policy of joining the Protocol on the Prohibition of the Use of Children in Armed
Conflict. Fifth, there is a major challenge in imposing punishments, including the execution of children under
the age of 18 in criminal offenses punishable by retribution, and the imposition of certain corporal punishment
in Iranian criminal law.
