Conceptual Overview of the Statutory Provisions for Crimes Relating to Children

Anu Singh, Tabbusum Khan.

Abstract
This research paper elucidates provisions relating to the protection and welfare as they exist in various statutes in India. The introduction talks about the physical and mental vulnerability of children which makes them an easy target in the eyes of the perpetrators. Further, the paper discusses the provision of the Indian Penal Code, 1908 which grants special status to children in some aspects like exempting them from punishment for certain crimes due to their sensitive age, and punishable offences against children like Foeticide, infanticide, abandonment and sexual assault. Homelessness and the condition of people have contributed to the killing of children in particular. Another big issue is the neglect of children. Some legislation to protect minors, civil rights and serious acts and their implications for definitions are discussed in the court system. The Constitution also grants special protection to the children which has been talked about in the research paper and the adoption laws in the country have also been briefly discussed. The paper concludes with the need of enforcement of such laws.

Key words: Adoption, Children, Constitution, Indian Penal Code, Infanticide
