Collective Bargaining and Labour Law

Abstract
The negotiating approach to address problems, disagreements and tensions between individuals and classes is as ancient as civilization. In olden history, there was consultation, consultation and informal agreement to settle party and group conflicts, but the background of trade unions is as old as civilization of the Indian industrialization begun and during mid-19th century. This research paper talks about the practice of collective bargaining with respect to the negotiations held by the trade unions for the welfare of the workers of an organization. The paper discusses the various laws including the ones in the Constitution that enable the creation of the trade clusters besides processes such as united negotiating. The inception of trade unions act and the provision of registration have also been discussed. The paper concludes with talking about the importance of the trade unions and the exercises such as collective bargaining and how in India, because of the proper provisions in place and their implementation, there is a healthy environment with regards to the resolution of disputes among the workers and the employers.
